As my sister's attorney said...she'd have had better success financially had her injury happened in a car wreck than on the job.
She injured her back 11 years ago. She is now 34 and on disability.
She has had 3 back surgeries (one to try to fix her back without fusion, another a fusion, and the final, the fusion removal).
She suffers from pain daily, and became addicted to Lortab in the process, so now faces that demon daily.
They have allowed her, as part of her settlement, to keep the back portion of her case open forever, so she can always seek treatment on her back for free...however, monetarily, she got $18k.
Why so low? Most state worker's comp. clauses are what they call "not at fault"...so, if you were doing somersaults on your job or they caused the injury, worker's comp pays.
If you were doing something stupid, you're protected, but it moreso protects the employer than the worker.
Your life is fudged up and what she got was barely even enough to cover a year's worth of work.
BTW: If you are offered an amount, make SURE you decide whether you are willing to accept that amount or not.
My sister was on weekly worker's comp payments, and when she declined the $19k lump sum payment (and who, at 25 wouldn't fight such a paltry amount when you're talking your future and questionable ability to ever work again?) and fought it in court, the judge felt their offer was too high, and ordered $18k to be paid out, in the form of weekly payments that she was already getting, for a year and a half.
